Right of Publicity – A Continuing Threat to the Fantasy Industry

A lawsuit has reached the Indiana Supreme Court with far-reaching implications for the fantasy industry. While the case has several aspects, the most notable is that the plaintiffs wish to restrict the right of publicity–this is the right that allows fantasy sports operators to use player names and statistics in our games. Attorneys Rudy Telscher and Kara Fussner have authored the FSTA’s amicus brief on behalf of the industry and will provide background on the case.
